Injured on the job?
Mann and Mann will ensure that you get your rightful benefits. Our firm represents people injured at work throughout the workers compensation process. All employers throughout California are required to carry workers compensation insurance coverage. Injured workers are entitled to lost wages, medical benefits, and various additional benefits and types of compensation. Workers comp is no-fault and was adopted so that injured employees need not prove that the injury was someone else's fault in order to receive workers' compensation benefits for an on-the-job injury.
Workers' Comp Benefits
Many workers compensation claimants are not fully aware of their rights and the benefits to which they are entitled. Our job is to make sure that you receive medical benefits, lost wages and other benefits and compensation that are often overlooked. Medical benefits may include chiropractic treatments and physical therapy benefits in addition to doctor’s visits and prescriptions. Some additional benefits that are available under workers compensation include: temporary disability, permanent disability, supplemental job displacement benefits, and death benefits.
What You Should Do
If you have been injured on the job, you should file a workers compensation claim within thirty days of your injury. You should then be able to see an approved doctor who will be reimbursed by your employer or by your employer’s workers comp carrier. After the injury is reported to the employer or the employer’s workers comp insurer, the employer controls the medical treatment for the first 30 days. After that, the employee is free to select a treating physician or facility. Sometimes it is possible to see your own personal physician from the date of the injury. If you have any problems receiving medical benefits, lost wages or other benefits, you should seek legal representation right away. If your employer tells you that you are not entitled to certain benefits, call our lawyers as soon as possible. We may be able to obtain a lump sum settlement for you.
